Landlords must reasonable accomodate legitimate ESAs whenever possible, and cannot typically reject or deny them housing.<\/span>\n<p><span style=\"font-weight: 400;\">However, there are some exceptions to the FHA. Certain types of housing, for example, are exempt from these laws. If the ESA also poses a significant risk, they may be legally denied. Read on to learn the answer to the question \u201cwhen can a landlord legally reject an ESA in Ohio?\u201d<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">What Is an ESA?<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">An emotional support animal is not the same as a <\/span><a href=\"https:\/\/usserviceanimals.org\/blog\/ultimate-guide-to-service-animals\/\"><span style=\"font-weight: 400;\">service animal<\/span><\/a><span style=\"font-weight: 400;\">, and they aren\u2019t covered by the same laws. This includes mental health difficulties such as anxiety and depression, as well as neurodivergency and many other disorders.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">ESAs don\u2019t have public access rights like service dogs, but they are allowed housing rights under the <\/span><a href=\"https:\/\/www.justice.gov\/crt\/fair-housing-act-1\"><span style=\"font-weight: 400;\">Fair Housing Act<\/span><\/a><span style=\"font-weight: 400;\">, and landlords cannot typically reject a valid ESA.\u00a0<\/span><\/p>\n<h2><span style=\"font-weight: 400;\">ESA Housing Laws in Ohio<\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Whether you are in Columbus or Toledo, <\/span><a href=\"https:\/\/usserviceanimals.org\/blog\/emotional-support-animal-ohio\/\"><span style=\"font-weight: 400;\">the law for ESAs in Ohio<\/span><\/a><span style=\"font-weight: 400;\"> is the same throughout. Use positive reinforcement training with your ESA to help them to act appropriately around others. You should also ensure they get the exercise and stimulation that they require, as excess energy, boredom, or excitability can quickly lead them to develop destructive habits.\u00a0<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">The ESA Could Cause Substantial Property Damage<\/span><\/h3>\n<p><span style=\"font-weight: 400;\">If your ESA causes significant damage to the property you\u2019re renting in Ohio, this is legal grounds for a landlord to reject them. This includes scratched furniture, chewed wires, damaged hardwood floors, or anything else that would be costly to fix or repair.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Note also that if your landlord has already accepted your ESA, but subsequently discovers that the animal is causing substantial property damage, they are within their right to ask that your ESA is removed from the property.
